Additional Charges in KP Sports Directorate Raise Questions Over Duration and Legal Authority

The practice of assigning Additional Charge, Acting Charge and Current Charge to employees in the Khyber Pakhtunkhwa Sports Directorate has raised questions about the applicable rules, duration of such arrangements and the authority responsible for approving their extensions.

Under certain Khyber Pakhtunkhwa government service rules, Acting Charge and Current Charge are treated differently from Additional Charge, with specific conditions governing when such arrangements may be made.

Similarly, the rules applicable in some KP government institutions provide a framework for Additional Charge, including provisions concerning its duration, extension and financial allowance.

However, the exact rules applicable to employees of the Sports Directorate need to be established from the service rules, notifications and instructions specifically governing the Directorate.

The key questions are therefore:

• For how long can an employee legally hold an Additional Charge?

• Under what circumstances can Acting Charge or Current Charge be assigned?

• Which authority is competent to approve the initial charge and its extension?

• How many times can such a charge be extended?

• Are employees receiving the applicable Additional Charge Allowance?

• How long have vacant posts in the Sports Directorate remained under temporary charge arrangements?

• Have permanent recruitment or promotion procedures been initiated for posts that have remained vacant for extended periods?

These questions are particularly relevant where an employee may be performing the duties of his or her substantive post while simultaneously holding another post on a charge basis for a prolonged period.

The issue does not automatically establish any illegality or misconduct. The legality of each case would depend on the applicable service rules, the original order, subsequent extensions and the authority that approved them.

A request under the Khyber Pakhtunkhwa Right to Information Act, 2013 has therefore sought the relevant notifications, orders, extensions, applicable rules, vacant-post details and financial payments relating to Additional, Acting and Current Charges in the Sports Directorate.

The records, once provided, can establish whether these arrangements are temporary administrative measures within the applicable rules or whether questions remain regarding their prolonged continuation.

The key issue is simple: temporary charge should be examined against the law, the duration approved, the competent authority and the documentary record, not merely against the designation used in an office order.
