RTI Filed to Probe Lease Payments for KP Sports Land Used by Culture & Tourism Department

PESHAWAR: Fresh questions over transparency and financial accountability have emerged after a Right to Information (RTI) application was filed seeking official records on the use of land belonging to the Khyber Pakhtunkhwa Directorate of Sports by the Culture and Tourism Department.

The application, submitted under the Khyber Pakhtunkhwa Right to Information Act, 2013, requests detailed information about the legal status of a building constructed by the Culture and Tourism Department on land owned by the Provincial Sports Directorate.

The applicant has sought certified copies of approvals, No Objection Certificates (NOCs), agreements, notifications and other official documents authorising the construction of the building. The RTI also seeks copies of any lease agreement, licence or Memorandum of Understanding (MoU) governing the use of the land.

The application further demands disclosure of the annual lease amount, the commencement and expiry dates of the lease, its terms and conditions, and whether the agreement has ever been renewed.

A key aspect of the request concerns financial transactions between the two government departments. The applicant has sought year-wise details of all lease payments, rent or any other financial compensation paid by the Culture and Tourism Department to the Directorate of Sports, along with payment vouchers, bills, treasury or bank records and supporting documents.

The RTI also asks the department to explain whether any lease payments remain outstanding. If so, it seeks copies of file notings, official correspondence and orders explaining why the dues have not been cleared.

The application further requests information on whether the building generates revenue through rent, commercial activities, ticket sales, events or any other source. If revenue is being earned, year-wise financial records have been sought.

In addition, the applicant has asked the department to disclose the legal basis if no payments have ever been made to the Directorate of Sports despite occupying its land, including copies of the relevant rules and decisions of the competent authority.

The request states that if any of the information cannot be disclosed, the department should provide written reasons as required under the Khyber Pakhtunkhwa Right to Information Act, 2013.

The applicant has also requested that all records be provided electronically in PDF format under the provincial government's Paperless Governance Policy.

The RTI application raises broader questions about the management of public assets and whether government departments have complied with legal and financial requirements while using land belonging to another public institution. The records sought are expected to clarify whether the occupation of the land is backed by formal agreements, whether lease obligations have been fulfilled, and whether the provincial exchequer has received the revenue due from the arrangement.
