Under-trial Prisoner Fights for Right to Education Behind Bars in Peshawar High Court

 

 

PESHAWAR, PAKISTAN: An under-trial prisoner, Tufail Zia, incarcerated at Peshawar Central Prison, has filed a petition with the Peshawar High Court challenging the denial of his admission to an M.Phil program in Political Science solely due to his imprisonment.

Advocate Nouman Muhib Kakakhel, representing Mr. Zia, argued that his client, despite being on trial for several years, retains his fundamental right to education, being a lawyer and a master's degree holder with a strong desire to continue his studies.

The petition emphasizes that while under-trial prisoners experience restricted movement, their fundamental rights, including education, as guaranteed by the constitution and legal instruments, remain intact.

Mr. Kakakhel implored the court to grant Mr. Zia permission to pursue his degree, either in person, through video conferencing like Skype, or by appointing a tutor within the prison premises.
