PHC directed HCC to submit Reply about rates before first week of July

          

PESHAWAR,( kikx now )  Chief Justice Peshawar High Court (PHC) has directed to Health Care Commission (HCC) to submit reply regarding uniformity fees of hospitals, clinics and laboratories were not implemented.

The case heard by two member-bench headed by Chief Justice PHC, which directed the Chief Executive Officer (CEO) HCC to submit the report before June -02 2020.

The CEO HCC requested the honorable court to grant for some to submit the report, which the CJ PHC accepted it and the case adjourned till June, 02, 2020.

Contempt of court petition was filed in Peshawar High Court for Non-Uniformity in rates of Laboratories, Clinics and Hospitals in wake of COVID-19 Epidemic.

Advocate Saifullah Muhib Kakakhel filed a contempt of court Petition in writ Petition no 4802-P/ 2017 in which division bench of Peshawar High Court headed by Chief Justice Waqar Ahmad Seth ordered Health Care Commission to fix and bring uniformity in rates of all laboratories, clinics and hospitals.

The petition is filed against CEO of Health Care Commission, Secretary Khyber Pakhtunkhwa and Director General Health, asking the court to punish them severely like Islamabad High Court recently sentenced Secretary Health to 6 months imprisonment for not implementing decision.

It is worth noting mentioning here that in writ petition No.3254-P of 2017 Popularly known as the Dengue Virus Case, through order of Peshawar High court, uniform rates of Dangue Test, MP and CBC were fixed by the Heal Care Commission by issuing a public notice. Which was highly beneficial for the public who could not afford the treatment, tests and medicines required.

The petition said up-to 9600 rupees is charged for COVID-19 tests even when the kits have been donated to Pakistan as a relief package. Mr. Kakakhel said that Shaukat khanum had been donated kits and funds as well whereas it is charging more than other private sector health facilities providers i.e. laboratories and hospitals.

He said that private laboratories/ hospitals are established as a trust and government has given them the properties and grants to establish hospitals, however, they instead of working for benefit of the public and health care, have turned into making money institutes.

He said these private laboratories/ hospitals have been given exemptions from taxes to import health machinery but they instead of serving the taxpayers are used for private benefits. He added some of these equipment’s are donated by NGOs and INGOs to carry out work for humanity.

He said the decision of this Hon’ble court is not being complied with because it would have an effect on rates of Shaukat Khanum as well which is being operated by Prime Minister Imran Khan. If rates are fixed and made uniform, Shaukat Khanum will be made cheap for the public as well, therefore the contemnors have blindfolded themselves to it.

He emphasized on the writ, saying that this court had ordered that Health Care commission is not made merely to issue license but also to regulate rates and all other work related to regulation of public/ private health sector for benefit of the public.

The petition further says that contemnors are not carrying out their duty and enjoying prerogatives of their jobs even though in wake of the epidemic there should be a proper check and balance on the hospitals and all under the eyes of the contemnors, so the poor are not expel
